Ex-pats of 15 years or more cannot vote in the EU Referendum

Shindler v UK (Application No. 19840/09)

The applicants, who were UK nationals that lived in Italy and Belgium respectively and who had not resided in the UK for over 15 years, challenged a rule which prevents them from voting in the EU referendum.  The Supreme Court upheld the decisions of the High Court and Court of Appeal by confirming that the 15 year rule applies.

European Court of Human Rights (ECtHR) upholds French full veil ban

In 2010 France introduced a law making it illegal for anyone to cover their face in a public place.  This case was brought by a French woman who argued that the ban on wearing the Muslim full-face veil, known as the Niqab, violated Article 8 ECHR (respect for private and family life), Article 9 (freedom of thought, conscience and religion) and Article 14 (prohibition on discrimination).

Hospital’s disposal of still-born child as clinical waste was unlawful

On 7th August 2003 a Croatian national gave birth to a still-born child at a public hospital in Split, Croatia.  The parents did not want to take the child’s remains, leaving the hospital to carry out an autopsy, and burial.  After the autopsy was carried out the hospital disposed of the child’s remains with their clinical waste.

ECJ declares EU data retention policy invalid

On 8th April the European Court of Justice (“ECJ”) ruled that an EU directive, requiring telecom operators to retain data for two years, is invalid.
